As outlined in this Privacy Policy, we collect, use and disclose information about you, both online and offline, in providing our Services and when you use our Services, whether through our website(s) (e.g., assurentadvisors.com), social media pages, and other electronic communications (each a “Site”). There may be additional notices of our offline privacy practices that we may provide to you at or before the time we collect your personal information.  Please read any such notices so you can understand how they apply to you.  This Privacy Policy also describes your privacy rights and how you can exercise them. By visiting or otherwise using our Sites or our Services, you are consenting to our collection and handling of your information as set forth in this Privacy Policy.     In the 12-months preceding the last updated and effective date of this Privacy Policy, we may have received, and may continue to receive, personal information about you from the following categories of sources: 1.a) Information you provide to us when you visit, access, or use any of our Sites or Services, engage in social media and other online activity associated with or relating to Assurent Advisors Private Limited, or apply for employment, including Employment Application Information, sensitive information, Wi-Fi and location information, device and browser information, and other information described below in Section 2 . 1.b) Information automatically collected through our website, social media platforms and online advertising services include device and browser information, Social Media Information and other information described below in Section 2. Information obtained from other sources, including third-party service providers, contractors and/or business partners, data analytics providers, employment recruiting agencies, your family, friends and former employers, data brokers, such as public databases, credit bureaus, credit reporting service providers, background check service providers, regulators and other government agencies include information described below in Section 2. Third-party data collection, storage, disclosure and other activities are subject to those third parties’ privacy policies and practices. Assurent Advisors Private Limited makes no representations regarding, and is not responsible or liable for, the accuracy or completeness of the information provided by third parties or for those third parties’ policies or practices. We may combine such third-party data with other information we acquire or receive from or about you in order to provide our Services. 1.c) Service providers, such as benefits administrators and others who process personal data on Assurent Advisors Private Limited’ behalf, such as when we request background checks as part of our hiring processes.

    In the 12-months preceding the last updated and effective date of this Privacy Policy, we have, and continue, to collect personal information from you and from various other sources in a variety of ways. Assurent Advisors Private Limited may collect the following categories of personal data and process that data for the business purposes set forth in the chart below.

For example, when you visit, use, or access our Site or Services, you may provide us with your social security number or bank account number.

When you visit, use or access our Site or Services, we may collect information about your activities including your service inquiries.

    Biometric Information meaning physiological, biological, or behavioral characteristics including imagery of the iris, retina, fingerprint, face, facial recognition, hand, palm, vein patterns and voice recordings, intended to be used singly or in combination with each other or other identifying data to establish individual identity. For example, when you call us to inquire about any of our Services and we receive your voicemail messages, we may which may incorporate the use of voice recognition technology for fraud prevention and other purposes.

    • To fulfill our legal obligations as they may arise from time to time, such as temperature checks prior to entry into office space or events
    Internet or other electronic network activity including Internet Protocol (IP) address, browsing history, search history, interaction with an internet website, application or advertisement. When you visit, use, or access our Site or use our Services, we may collect (directly or through third parties) your IP address, information about the type of device and browser you are using, your interaction with our website, the websites you visit, your precise physical location, etc. Assurent Advisors Private Limited and its third-party service providers may also collect and use “cookies” and similar technologies to improve, enhance and optimize your online experience with our website, to conduct website traffic and other data analytics, and to modify, improve and enhance any of our Sites and Services. When you use integrated social media features associated with or relating to Assurent Advisors Private Limited and its Site or Services, or other social media websites or mobile applications, we may obtain information including your name, online profile, e-mail address, and videos, recordings and images of you (“Social Media Information”).  For more information about the cookies we use, please see the  section of this Privacy Policy discussing Cookies below.

    Professional or employment-related information, including information on a resume or curriculum vitae, employment history, education history, certifications, languages, security clearance information, work authorization, past and expected compensation, information of professional and personal references and referral sources, emergency contact information, and other work-related information. When you apply for a job with us, you may provide us with your work history, and we may collect background and other security clearance information as part of the employment application process (“Employment Application Information”).

    Educational information includes information that is not publicly available personally identifiable information as defined in the Family Education Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99). If you apply for a job with us, you may provide us with your resume and non-public education history.

    Inferences drawn from other personal information may be used to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes including assessment of aptitudes, abilities and preferences.

    Sensitive personal information includes social security number, driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; a consumer’s precise geolocation; a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; contents of a consumer’s mail, email, and text message to recipients other than us; and genetic data. As above, when you make a visit, use, or access a Site or our Services, engage in other transactions or activities with us, or apply for a job, we may collect your financial account, credit or debit card number, your social security number, driver’s or state identification card numbers, precise geolocation, union membership, and other sensitive personal information.
    • While we collect information that falls within this category of sensitive personal information for the same purposes for Identifiers, Personal information described in Cal. Civ. Code 1798.80 (e), Characteristics of protected classifications; and Biometric information, Assurent Advisors Private Limited does not collect or use sensitive personal data for the purposes of uniquely identifying you or inferring characteristics about you.
      Not Intended for Children: Assurent Advisors Private Limited does not intend to, nor do we knowingly collect, use, share, disclose or sell personal information of children under 16 years of age, with or without parent or guardian authorization. If a parent or guardian of a child under 13 believes that the child has provided us with any personal information, the parent or guardian should contact us by email at info@assurentadvisors.com, by phone at 079 460 27274 or by mail to 1165 Lincoln Ave Number 8730 San Jose, CA 95155, Attention: PRIVACY INQUIRY, and ask to have this personal information deleted from our files

    3. Disclosure and Transfer of Personal Data

    Assurent Advisors Private Limited does not knowingly sell your personal data to third parties for monetary or other valuable consideration. Assurent Advisors Private Limited does not share your personal data with third parties for cross-context behavioral advertising. Where necessary in order to achieve the business purposes of Assurent Advisors Private Limited, we may disclose your personal data with contractors and/or service providers that we engage pursuant to written agreements. Such contractors and/or service providers, also referred to as “data processors,” will only process personal data pursuant to written agreements and in accordance with Assurent Advisors Private Limited’ instructions, in order to achieve the business purposes of Assurent Advisors Private Limited, as further described in Section 3.1. Assurent Advisors Private Limited may also be required to disclose your personal data to government agencies or other categories of recipients external to Assurent Advisors Private Limited that are described in Section 3.2, who will process personal data in the capacity as “data controllers,” i.e., these recipients will determine the purposes and means of the processing without Assurent Advisors Private Limited’ involvement. Please note however that Assurent Advisors Private Limited will disclose your personal data with such recipients only as required or allowed by law and only to the extent necessary.

    3.1 Contractors and Service Providers (data processors) acting on behalf of Assurent Advisors Private Limited 

    In order to fulfill Assurent Advisors Private Limited’ business purposes of the processing of your personal data and to be able to run our business, we may disclose or transfer personal data to contractors and/or service providers that we have engaged pursuant to written agreements. These parties provide services within the areas of, among others, IT (such as data storage and management services), finance and HR (e.g., our HR management system). These external parties will act as data processors of Assurent Advisors Private Limited and may only process your personal data in accordance with our instructions and not solely for their own or any other party’s purposes. Assurent Advisors Private Limited is the data controller for the processing of personal data that these external parties carry out on our behalf. Further, we may have disclosed, or we may disclose your personal information as follows:
    • Third-party service providers and/or business partners: We use vendors, consultants and other service providers and/or business partners to assist us in providing our Sites and Services, and it may be necessary for us to provide them with access to your personal information, e.g., service providers who provide IT support, who provide background checks, and who provide software solutions as part of or necessary for us to provide our Services.
    • In compliance with laws, at your consent or direction, and to protect rights, property and safety: We may preserve and disclose your information if we believe doing so is legally required or appropriate: (i) to comply with applicable laws and regulations, law enforcement or national security requests and legal process, such as a court orders or subpoenas; (ii) in response to your consent or at your direction to disclose the information; (iii) to protect your, our, or another’s rights, property, or safety; or (iv) to enforce our rights, policies and/or contracts.
    • Merger, Sale, or Other Asset Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another person or entity, then your information may be disclosed as part of such a transaction as permitted by law and/or contract.
    • With your consent: We may disclose your personal information for other purposes per your request or with your consent.

    4. Security of Information

    We maintain reasonable safeguards to protect our systems from unauthorized access or use and to protect information from accidental or unauthorized access, use, disclosure, modification, loss or destruction.  We require third parties providing services on our behalf to do the same.  However, no security system is impenetrable.  We monitor to detect potential threats to security and in the event of a compromise, we will immediately conduct an investigation, including forensics if appropriate, and will contain and minimize any compromise to the confidentiality, integrity and availability of data. Our personnel are required to take reasonable measures to ensure that unauthorized persons cannot view or access your personal information.  Employees who violate our internal privacy policies are subject to disciplinary action, up to and including termination of employment. We cannot enforce or control the security of the computers, electronic devices, or electronic communication methods you may use to send e-mails or submit information to us. You are responsible for the security of the computers, electronic devices, and electronic communication methods you use to communicate with us.  We are not responsible for the disclosure or interception of information you send to us.

    5. Data Retention

    Assurent Advisors Private Limited will retain personal data for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. We are applying the following criteria to establish our retention periods: (i) as long as we have an ongoing client-provider relationship with you (or for a shorter period provided that the personal data is no longer necessary in relation to the purposes for which they were collected); (ii) as required by legal obligations to which Assurent Advisors Private Limited is subject; (iii) as advisable in light of our legal position (such as applicable statutes of limitations) in order to establish, exercise and defend against legal claims; and (iv) as necessary to meet our legitimate business needs (such as for forecasting, planning, follow-up and documentation purposes).

    6. California Privacy Rights

    If you are a resident of California, you have rights with respect to your personal information pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Right Act, Cal. Civ. Code §§ 1798.100 et seq., and implementing regulations, as may be amended from time to time (collectively, the “CCPA”), as follows:

    6.a) Right to be know and access your personal information:

    You have the right to know what personal data is being collected about you and the right to access that personal data. You have the right to request that we disclose (1) the categories of personal data we have collected about you; (2) the categories of sources from which the personal data is collected; (3) the business or commercial purposes for collecting your personal data, as well as for the selling or sharing to third parties of your personal data, if any; (4) the categories of parties external to Assurent Advisors Private Limited to whom we disclose your personal data; and (5) the specific pieces of personal data collected about you. You also have the right to request a copy of the personal data undergoing processing. If the request is made by electronic means the information will be provided in a commonly used electronic format if you do not request otherwise.  We are required to fulfill such a request no more than two times within a 12-month period.

    6.b) Right to correct inaccurate personal information: 

    If the personal information we have about you is inaccurate, subject to certain exceptions, you have the right to request that we correct that inaccurate personal information, taking into account the nature of the personal information and the purpose of the processing of that personal information. We will use commercially reasonable efforts to correct inaccurate personal information.

    6.c) Right to request deletion of your personal information:

    You have the right to request that your personal information be deleted, subject to certain exceptions.  For example, your request to delete is subject to the need to complete transactions for which the personal information was collected and to comply with legal obligations.

    6.d) Right to opt-out of the sale of personal information:

    Assurent Advisors Private Limited does not knowingly sell personal information for monetary exchange to third parties. However, you have the right to opt-out of having your personal information sold to or shared with third parties.
    • The use of certain cookies placed by third parties on our Site(s) may constitute a sale or sharing of personal information under California law.  In addition to submitting your request or calling us, as described below in “How To Submit A Request,” to fully exercise your California privacy right to opt out, you may clear cookies and turn off cookies by using  your web browser settings (see section discussing Cookies below). The cookie preference tool is device and browser specific. If you delete or clear cookies or change devices or browsers, you will need to reset your cookie preferences using your web browser settings.  Please note that even if you opt-out of the sale or sharing of your personal information, we may still disclose your personal information to third-party service providers and/or business partners and other government entities for business or commercial purposes consistent with the California Privacy Rights, or as legally required of us.
    • With respect to cookies and similar technologies, during the 12 months preceding the last updated and effective date of this Privacy Policy, we may have sold or shared (as may be defined by California law) three categories of personal information, specifically, Identifiers, Internet and other electronic network activity, and Inferences, for online advertising purposes and to provide third-party social network platform functionality on our website.

    6.e) Right to limit use and disclosure of sensitive personal information: 

    You have the right to request that we limit the use of your sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average customer who requests those goods or services, to perform business purposes described in Section 3 above, and as authorized by applicable laws and regulations.

    6.f) Right not to be discriminated against:

    In exercising any of the foregoing consumer privacy rights, you have the right not to be discriminated against. Assurent Advisors Private Limited will not deny you Services, charge you different prices or rates for goods or services, or provide you a different level of Services for exercising your rights, unless the difference is reasonably related to the value of your information.

    6.g) How to Submit a Request and Our Verification Procedures

    You may also designate an Authorized Agent to make a request on your behalf. You may make such a designation by providing the Authorized Agent with your written and signed permission to act on your behalf and by directly confirming with us that you have provided the authorized agent permission to submit the request. As permitted by law, we may require you to verify your identity in response to a request even if you choose to use an Authorized Agent. The Authorized Agent will also need to verify its own identity directly with us.  Thus, we will need to contact you as requests through an Authorized Agent require additional identifying information and a signed declaration under penalty of perjury, attesting to your and your Authorized Agent’s identities. After you or your Authorized Agent submit a request, we require a high degree of certainty that we have verified that the requester is, in fact, the California consumer whose personal information is the subject of the request. We will endeavor to do so using the personal information that we, or one of our third-party service providers and/or business partners, have about the consumer.  We may need to obtain additional personal information from you or from other third-party sources to verify the requester’s or Authorized Agent’s identity, in which case, such additional personal information will be used solely for verification purposes.  If we are unable to verify your identity, we reserve the right to deny your requests.

    6.h) California “Shine the Light” Law:

    California’s “Shine the Light” law (California Civil Code section 1798.83) gives California residents the right to ask, once a year, (1) what personal information was disclosed  to third parties for those third parties’ direct marketing purposes in the prior calendar year; and (2) the identities of the companies with whom the information was shared. The terms “customers” and “personal information” have the meaning given by the Shine the Light (California Civil Code Sec 1798.83). We do not share personal information, as defined in California Code Civil Section 1798.83, with third parties for their direct marketing purposes absent your consent.  If you are a California resident, you may request information about our compliance with California’s Shine the Light law by sending us a written request to info@assurentadvisors.com or mailing us a letter addressed to: Assurent Advisors Private Limited 1165 Lincoln Ave Number 8730 San Jose, CA 95155 (Attention: “Shine the Light” Inquiry). Any such written request must include “California Shine the Light Law Request” in the first line of the description and include your name, street address, city, state, and zip code.  We are only required to respond to one Shine the Light law request per customer per year, and we are not required to respond to requests made by means other than through this email address and mailing address. Further note that “Shine the Light” rights and the California Privacy Rights under subsections A through G in this Section 5 are provided under different statutes and must be exercised separately.

    7. Your Preferences and Opt-Out Rights

    7.a) Marketing and Promotional Communications:

    In accord with your marketing preferences and applicable privacy and data protection laws, we may send you updates via email about opportunities or Services we think may be of interest to you, including newsletters, articles, surveys, and event information.  If you would like to discontinue receiving such marketing or promotional communications from us, you can unsubscribe or opt out at any time.  Where you have consented to our processing of your information, you may withdraw that consent at any time and opt-out of further processing. If you wish to opt out of receiving marketing or promotional emails from us, click on the unsubscribe link at the bottom of such email, and follow the instructions to unsubscribe, opt out or otherwise set your communications preferences. If you wish to opt out of solicitations from us via mail, phone, text message and/or push notification, or you do not want us to share your personal information for marketing purposes with third-party service providers, our business partners, or other third parties, please submit your request via e-mail to info@assurentadvisors.com or by mail with a letter addressed to: Assurent Advisors Private Limited 1165 Lincoln Ave Number 8730 San Jose, CA 95155 (Attention: Privacy Inquiry / Opt-Out). Although you may opt out of the use and sharing of personal information for marketing purposes, we may still use and disclose information we collect for our other, non-marketing business and commercial purposes, described above.     What are Cookies?
